These conditions (“the conditions) supplied by “DoveCote Wedding Cars” (“the company”) to a customer (“the customer”) shall be incorporated into each contract (“the contract”) made by the company for the supply of goods (“the goods”) and service (“the service”) and hiring out of vehicles by the company.  The company contracts as aforesaid upon such terms as are agreed between the company and the customer and the terms of the conditions alone.  No variation of any of the conditions shall be effective unless in writing and signed by a duly authorized representative of the company.

 

These terms

1.1 What these terms cover. These are the terms and conditions on which DoveCote Wedding Cars (the Supplier) will supply services to you.

1.2 Why you should read them. Please read these terms carefully before you submit your booking with us. These terms tell you who we are, how we will provide services to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.

  1. Information about DoveCote Wedding Cars and how to contact DoveCote Wedding Cars

2.1 Who we are. We are Trading as DoveCote Wedding Cars, our registered office is at DoveCote House, Doncaster Road, Withley, North Yorkshire DN140HZ.

2.2 Our role. We provide wedding cars for weddings only.

2.3 How to contact us. You can contact us by telephoning us on 01977 663394 or 07725629946 or by writing to us atinfo@dovecoteweddingcars.co.uk.

2.4 How we may contact you. If we must contact you, we will do so by telephone or by writing to you at the email address or postal address you provided to us in your booking, in line with our privacy policy.

2.5 “Writing” includes emails. When we use the words “writing” or “written” in these terms, this includes emails and SMS.

  1. DoveCote Wedding Cars Services

4.1 Cars may vary slightly from their pictures. The car you book will be the actual car provided on the day.  However, the images of the cars on our website are for illustrative purposes only and are provided by DoveCote Wedding Cars. Although we have made every effort to display the colours and sizes accurately, we cannot guarantee that your computer, mobile phone or tablet will accurately display the colour and dimensions of the cars, thus your car may vary slightly from those images.

4.2 Cars may vary slightly from their description. The car you book will be the actual car provided on the day. The description of the cars on our website is for information purposes only and is provided by DoveCote Wedding Cars. Although we have made every effort to ensure that the information is correct at the time of publishing, we cannot guarantee that a device’s description accurately reflects the colour and dimensions of the cars. Your car may vary slightly its description.

4.3 The scope of DoveCote Wedding Cars services. In usual circumstances, the booking form and subsequent contract is for the collection of the Bridal party from the designated collection address and onward transportation to the Church. It also covers the journey of the newlyweds from the Ceremony venue to the designated reception venue. There are no extras to pay unless extra services are requested on the day of the service, these requests are at DoveCote Wedding Cars discretion and will be charged at DoveCote Wedding Cars hourly rate.

4.4 Special services excluded from contract. On occasions, at DoveCote Wedding Cars sole discretion, there may be other special instructions or services that are supplied, by special request, on a ‘no cost’ goodwill basis. Customers should be aware that extras that have not been charged for are strictly excluded from the contract, invoice or any refund which may occur. Therefore, no refund is ever due, in any circumstances, that a discretionary item is cancelled or unavailable for whatever reason. DoveCote Wedding Cars recommends that you are covered with adequate insurance.

4.5 Contracted service completion. Under usual circumstances, the service provided on the day will come to an end when the allocated time slot expires.  This end point is noted on the itinerary as the “free to leave time”, this is the time that you and DoveCote Wedding Cars agree that the contract is complete and the car is free to return to its base.  There is a degree of flexibility with this, as situations can happen outside of the hirers and suppliers’ control, for example but not limited to, traffic & weather.  Any extension should be discussed with and is at the discretion of the driver.  Any additions to the itinerary may result in further fees charged and after the event or covered on a goodwill basis as “special services excluded from contract” (4.4).

The contract may also come to an end if the car is no longer required and the driver has had instruction that he is free to leave.  This instruction could come from either the hirer, a member of the wedding party, the wedding planner, the official photographer or a person representing the wedding venue.

4.6 No food, drinks or smoking in cars. No food or drink will be allowed in the cars unless prior consent has been given by the Supplier. UK law prohibits smoking in cars used by the public and all our Suppliers adopt a strict No Smoking policy.

4.7 Choice of route. DoveCote Wedding Cars chauffeurs will choose the route based on experience, knowledge of the local area and use of satellite navigation, they will accept a route requested by you, however, should this result in extra mileage or time being added to the journey a charge may be made.

4.8 Late alterations to booking. Any alterations made to the booking on the day of the service or a request for additional time may incur an extra charge or may not be honoured if that conflicts with another booking.

4.9 Damages to the car. You will be responsible for the conduct of all passengers during the service and DoveCote Wedding Cars reserves the right to invoice or make a charge to you for any losses or damage sustained to any part of the car caused by any passenger or a third party incited to cause damage to the car. A minimum charge of £100 will be applied to cover valet costs should fouling be caused by any passenger through food, drink or illness.

4.10 Passengers’ misbehaviour. Violence, foul language, intimidation antagonism or any form of anti-social behaviour towards the chauffeur or any other member of DoveCote Wedding Cars staff will not be tolerated and will result in the immediate termination of the service and police involvement. Acts of vandalism or malicious damage caused to the car may face prosecution.

4.11 No responsibility for belongings left in the car. DoveCote Wedding Cars chauffeurs will check the car for passengers’ belongings left in the car after a service. However, we cannot be held responsible for any item broken during the journey or left in the car after the service. It is up to you to ensure you have all your belongings at the end of the service. If items are left in the car, they must be collected by the hirer from our office.

4.12 Confidentiality of information. DoveCote Wedding Cars offers a policy of total discretion for all clients, our chauffeurs will not discuss who travelled with them, to where or with whom unless authorised by you to do so. The exception to this policy is wedding photography for company promotional purposes. Therefore, unless formally instructed to the contrary, we may take photographs at weddings and publish them in its literature or on its or our website. If you do not wish to have your images used please make us aware of this in writing when paying the deposit or balance of the service.

4.13 Extras. There are no extras to pay unless extra services are requested on the day of the service, these requests are at the discretion of the DoveCote Wedding Cars and will be charged at our hourly rate.

4.14 No alcohol generally allowed. DoveCote Wedding Cars does not hold a premises or personal alcohol licence and DoveCote Wedding Cars is prohibited from including the sale of alcohol as part of our fee for providing a wedding car service.  However at our chauffeur’s discretion, all our cars carry a cooler box and two champagne flutes, if you would like to give a bottle of champagne and a bag of ice to our chauffeur at the beginning of the wedding he will place this in the cooler box for you after the ceremony.  Discretion is applied in several scenarios, for example, but not exclusively:

  • where the customer has not requested it.
  • where there is no onward journey from the ceremony venue.
  • where the journey to the reception venue is short.
  • where DoveCote Wedding Cars is prohibited by the local council to which they are based or are providing the service.

Please check with DoveCote Wedding Cars directly if this element of the service is required or expected.

  1. Your rights to make changes

5.1 If you wish to make a change to the car/s you have ordered please contact us. If it is possible we will let you know about any changes to the price of the car, the timing of supply or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change. If we cannot make the change or the consequences of making the change is unacceptable to you, you may want to end the contract. Your rights to do this are set out below.

  1. DoveCote Wedding Cars rights to make changes

6.1 Minor changes to the cars. The Supplier may change the car:

  • to reflect changes in relevant laws and regulatory requirements
  • to implement technical adjustments and improvements, for example to address a security threat.

These changes will not affect your use of the car.

6.2 More significant changes to the services. In addition, DoveCote Wedding Cars may make more substantial changes to the cars, but if DoveCote Wedding Cars does we will notify you and you may want to end the contract before the changes take effect and receive a refund for anything that you have paid up to that date.

6.3 Extreme weather.  In the event of adverse weather conditions on the day of the event, either current or forecasted, DoveCote Wedding Cars reserves the right to change the car or cancel the contract (in line with clause 7.5).  This is done in the interests of safeguarding both passengers and the car.  Adverse weather conditions may include but are not limited to snow, ice & floods.

6.4 Changes to our terms. We may change these terms from time to time, but the terms applicable to your booking will be the terms in force when the booking was made, unless you agree to the change or the change is required due to a change in law.

  1. Providing the services

7.1 When DoveCote Wedding Cars will provide the services. DoveCote Wedding Cars will provide the services on the date set out in the booking confirmation.  The booking cannot be transferred to another date, unless your wedding has been cancelled due to any reasons given in point 8.4.

7.2 What will happen if you do not give the required information to us. We may need certain information from you so that DoveCote Wedding Cars can provide the services to you, for example, the number of people in the car and addresses for pick-up and drop-off. We will contact you to ask for this information. If you do not give us this information within a reasonable time of us asking for it, or if you give us incomplete or incorrect information, we may either end the (and Clause 10.2 will apply) or make an additional charge of a reasonable sum to compensate DoveCote Wedding Cars for any extra work that is required as a result. DoveCote Wedding Cars will not be responsible for providing the services late if this is caused by you not giving us the information DoveCote Wedding Cars needs within a reasonable time of us asking for it.

7.3 DoveCote Wedding Cars is not responsible for delays outside our control. If DoveCote Wedding Cars supply of the services is delayed by an event outside DoveCote Wedding Cars control, for example, but not exclusive to, heavy traffic or road closures, then DoveCote Wedding Cars will contact you as soon as possible to let you know and DoveCote Wedding Cars will take steps to minimise the effect of the delay. Provided DoveCote Wedding Cars does this DoveCote Wedding Cars will not be liable for delays caused by the event. We recommend that you are covered with adequate insurance. On the contrary, if DoveCote Wedding Cars supply of the services is late due to our fault, then you may treat the contract as at an end straight away but must tell DoveCote Wedding Cars before making use of the services. If you use the car you will lose your right to terminate but may still be entitled to a part refund.

7.4 Your rights if the car becomes unavailable prior to the wedding day. DoveCote Wedding Cars will contact you in advance to tell you that we cannot provide the services agreed, unless the problem is urgent or an emergency, for example, but not exclusive to theft, damage or breakdown, which occurs less than 24hrs prior to the commencement of the planned itinerary (if so, clause 7.5 will apply). If we are no longer able to provide you with the contracted car, for example, but not exclusive to theft, damage or breakdown which cannot be repaired before the date of the booking, we will give you the possibility to choose another car of a similar specification, if available. If we are unable to source a similar car (which may be provided by a different Supplier), we will offer you the possibility to choose between an alternative car and a part refund (if the booking value of the car is less than the value of the original car) or a full refund. If you opt for the latter, the contract will be considered terminated (and Clause 7.6 will apply).

7.5 Your rights if the car becomes unavailable on the wedding day. You acknowledge that if an issue arises with the car or chauffeur on the day of the booking (or within 24hrs of the commencement of the planned itinerary) or during the delivery of the service, the ability to source another similar car may be limited.  You consent to enable us to arrange an alternative vehicle on your behalf, if we are unable to source a similar car (which may be provided by a different Supplier), we will take action to provide your transportation in any available vehicle (which may be provided by a different Supplier).  If an alternative car is provided and the booking value of the car is less than the value of the original car, the difference may be due as a part refund. If an alternative car cannot be provided in a suitable time frame then the contract will be considered terminated (and Clause 7.6 will apply).

7.6 Your rights to end the contract because of something DoveCote Wedding Cars has done or is going to do. If you are ending a contract for a reason set out at (a) to (f) below, the contract will end.  A refund or part refund may be due from DoveCote Wedding Cars which will be refunded by us, this will be paid proportionally and will not exceed the total booking value, within 7days of the termination.  The reasons are:

  1. a) DoveCote Wedding Cars has told you about an upcoming major change to the services or these terms which you do not agree to (see Clause 6.2);
  2. b) we have told you about an error in the price or description of the car you have ordered, and you do not wish to proceed (see Clause 12.2);
  3. c) the supply of the car is significantly delayed because of DoveCote Wedding Cars fault.
  4. d) on the day DoveCote Wedding Cars failed to deliver the agreed terms of service.
  5. e) DoveCote Wedding Cars has notified you we are unable to provide you with the contracted car (and no suitable alternative is available); or
  6. f) you have a legal right to end the contract because of something DoveCote Wedding Cars has done wrong.
  7. Your right to end the contract

8.1 The hirers due diligence.  You must perform your own due diligence to ensure your requirements are met before placing the booking.  The hiring of a car for a wedding falls within this category.

8.2 There is no statutory right to cancel. You do not have a statutory right to change your mind in respect of contracts for the supply of accommodation, transport of goods, car rental services, catering or services related to leisure activities, if the contract provides for a specific date or period of performance.  Therefore, if you end the contract before it is completed, where DoveCote Wedding Cars is not at fault, you may have to pay DoveCote Wedding Cars compensation. A contract for services is completed when DoveCote Wedding Cars has finished providing the services and you have paid for them.

8.3 Cancellation where DoveCote Wedding Cars is not at fault.  If you want to end a contract before it is completed where DoveCote Wedding Cars is not at fault, just contact us to let us know. The contract will end immediately, but we DoveCote Wedding Cars will keep any money you have paid in advance as a deposit and may charge you a cancellation fee as compensation for the DoveCote Wedding Cars will incur as a result of your ending the contract. The amount of such a cancellation fee will be dependent on the date on which you end the contract. If the cancellation is communicated more than 10 weeks before the wedding then 50% of the total booking price is due, and you will be required to pay the difference between your deposit and this charge. If you cancel within 10 weeks or less, then all of the remaining balance is due.

8.4 Cancellation fee exemptions in the event of postponement.  If your event has been cancelled and you need to change the date due to any of the reasons listed from (a) to (d) in this clause, DoveCote Wedding Cars will allow you to transfer the booking to an alternative date, provided the new booking date is within 90 days before or after the original date, subject to availability and evidence provided. If the new booking date falls outside of this time frame, then clause 8.3 will come into effect.  The original payment schedule must be adhered to, if the hirer fails to adhere to the original payment terms then clause 8.3 will come into effect.  If there is a price increase due to either a change of vehicle or date (the pricing structure may have seasonal variations), then the hirer must pay the additional cost at the point of the change.

If the bride or groom would like to reschedule it to a Friday, Saturday or Sunday in a prime summer time wedding April to September there would have to be an extra charge of 50% of the original booking cost to pay on top of the original booking to reschedule to these dates.

If the bride and groom choose a date when the car is already booked out for another bride and groom, we would have to replace the car with another wedding car of equal value.

  1. a) The venue cancels the booking.
  2. b) A change to government or local council policy which prevents the event from taking place on the original booking date.
  3. c) The Bride and/or Groom, or immediate family member falls critically ill or dies.
  4. d) Unavoidable catastrophes that interrupt the expected course of events (Force Majeure), this includes, but not limited to extreme weather, terrorist attacks, a pandemic (as confirmed by The World Health Organisation).
  5. How to end the contract with DoveCote Wedding Cars

Tell us you want to end or cancel the contract. To end the contract with DoveCote Wedding Cars, please let us know by doing one of the following:

Phone or email. Call us on 01977 663394 or 07725629946 or email us at info@dovecoteweddingcars.co.uk. Please provide your name, home address, details of the booking and, where available, your phone number and email address and booking reference number.

  1. DoveCote Wedding Cars rights to end the contract

10.1 DoveCote Wedding Cars may end the contract if you break it. DoveCote Wedding Cars may end the contract for a service at any time by writing to you if:

you do not make any payment when it is due, and you still do not make payment within 7 days of DoveCote Wedding Cars reminding you that payment is due: or

you do not, within a reasonable time of us asking for it, provide us with information that is necessary for DoveCote Wedding Cars to provide the services, for example, addresses for pick-up and drop-off.

10.2 You must compensate DoveCote Wedding Cars if you break the contract. If DoveCote Wedding Cars ends the contract in the situations set out in Clause 10.1, DoveCote Wedding Cars will keep any money you have paid in advance as a deposit and may charge you a cancellation fee as compensation for the costs DoveCote Wedding Cars will incur as a result of your breaking the contract. The cancellation fee will be calculated on the basis set out in Clause 8 above.

10.3 Authorised agents. DoveCote Wedding Cars has authorised agents to liaise with you for the purposes of this clause.

  1. If there is a problem with the service

11.1 How to tell us DoveCote Wedding Cars about problems. If you have any questions or complaints about the service, please contact us. You can telephone us on us on 01977 663394 or 07725629946 or write to us at info@dovecoteweddingcars.co.uk. If the problem arises.

11.2 Summary of your legal rights. DoveCote Wedding Cars is under a legal duty to supply services that are in conformity with this contract. See the section below for a summary of your key legal rights in relation to the car service. Nothing in these terms will affect your legal rights.

Summary of your key legal rights

This is a summary of your key legal rights. These are subject to certain exceptions. For detailed information please visit the Citizens Advice website www.adviceguide.org.uk or call 03454 04 05 06.

Because your product is services, the Consumer Rights Act 2015 says:

  • you can ask DoveCote Wedding Cars to repeat or fix a service if it’s not carried out with reasonable care and skill or get some money back if DoveCote Wedding Cars can’t fix it.
  • if you haven’t agreed a price beforehand, what you’re asked to pay must be reasonable. This may apply to any additional services requested on the day.
  • if you haven’t agreed a time beforehand, it must be carried out within a reasonable time. All our bookings are for a specific time and place.
  1. Price and payment

12.1 Where to find the price for the car. The price of the car will be the price indicated on the booking pages when you placed your booking. We use our best efforts to ensure that the price of the service advised to you is correct. However please see Clause 12.2 for what happens if we discover an error in the price of the product you are booking.

12.2 What happens if we got the price wrong. It is always possible that, despite our best efforts, some of the services we promote may be incorrectly priced. We will normally check prices with DoveCote Wedding Cars before accepting your booking so that, where a product’s correct price at your booking date is less than our stated price at your booking date, we will charge the lower amount. If the product’s correct price at your booking date is higher than the price stated to you, we will contact you for your instructions before we accept your booking. If we accept and process your booking where a pricing error is obvious and unmistakable and could reasonably have been recognised by you as a mispricing, we may end the contract and refund you any sums you have paid.

12.3 DoveCote Wedding Cars payments. We accept payment by BACS, in which case no extra charges apply to you. DoveCote Wedding Cars will invoice you for the total price of the services when we confirm acceptance of your booking. You must make an advance payment of 25% of the price of the services within 3 days of the date of the invoice. If you fail to do this, we may end the contract as set out above. You must pay the remaining balance of the invoice is due 60 days before the wedding date shown on the booking form. In the event that you want to book cars at short notice, for these bookings (made within 6 weeks of the service) the full balance will be due at the time the booking is confirmed.

12.4 We can charge interest if you pay late. If you do not make any payment to us by the due date DoveCote Wedding Cars may charge interest to you on the overdue amount at the rate of 2% a year above the base lending rate of Lloyds Bank plc from time to time. This interest shall accrue on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You must pay DoveCote Wedding Cars interest together with any overdue amount.

12.5 What to do if you think the price is wrong. If you think the price is wrong, please contact us promptly to let us know. You will not have to pay any interest until the dispute is resolved. Once the dispute is resolved DoveCote Wedding Cars will charge you interest on correctly invoiced sums from the original due date.

  1. DoveCote Wedding Cars responsibility for loss or damage suffered by you

13.1 DoveCote Wedding Cars is not responsible to you for any loss or damage caused by failure to deliver their service. DoveCote Wedding Cars is not responsible for any further loss or damage you may incur that is a result of DoveCote Wedding Cars failure to deliver the service expected, other than the booking value of the hire of their service, provided they have taken reasonable care in the provision of their services. It is our recommendation and the responsibility of the hirer to have an adequate wedding Insurance policy to cover loss or damage caused by DoveCote Wedding Cars failing to deliver our service.

13.2 DoveCote Wedding Cars does not exclude or limit in any way DoveCote Wedding Cars liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by DoveCote Wedding Cars negligence or the negligence of DoveCote Wedding Cars employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the services as summarised at Clause 11.2.

13.3 No responsibility as agents. We act as agent for DoveCote Wedding Cars and have no liability to you for the supply of the services. This is DoveCote Wedding Cars responsibility.

  1. How we will use your personal information.

14.1 This is as set out in our privacy policy.

14.2 We will provide your details to DoveCote Wedding Cars.

14.3 We will only give your personal information to other third parties where our Privacy Policy allows us to or if the law either requires or allows us to do so.

  1. Other important terms

15.1 DoveCote Wedding Cars may transfer this agreement to someone else. DoveCote Wedding Cars may transfer its rights and obligations under these terms to another organisation or appoint a replacement agent. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.

15.2 You need DoveCote Wedding Cars consent to transfer your rights to someone else. You may only transfer your rights or your obligations under these terms to another person if DoveCote Wedding Cars agrees to this in writing.

15.3 Nobody else has any rights under this contract. This contract is between you and DoveCote Wedding Cars. No other person shall have any rights to enforce any of its terms, although we may take steps to enforce rights in our role as DoveCote Wedding Cars.

15.4 If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

15.5 Even if DoveCote Wedding Cars delays in enforcing this contract, it can still enforce it later. If DoveCote Wedding Cars does not insist immediately that you do anything you are required to do under these terms, or if DoveCote Wedding Cars delays in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent DoveCote Wedding Cars taking steps against you at a later date. For example, if you miss a payment and we do not chase you, but DoveCote Wedding Cars continues to provide the services, DoveCote Wedding Cars can still require you to make the payment at a later date.

15.6 Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by English law and you can bring legal proceedings in respect of the services in the English courts. If you live in Scotland, you can bring legal proceedings in respect of the services in either the Scottish or the English courts. If you live in Northern Ireland, you can bring legal proceedings in respect of the services in either the Northern Irish or the English courts.

15.7 Alternative dispute resolution. Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. If you are not happy with how DoveCote Wedding Cars has handled any complaint you may want to contact the alternative dispute resolution provider, we use. You can submit a complaint to the Chartered Trading Standards Institute via their website at https://www.tradingstandards.uk/about-ctsi/contact-the Supplier. The Chartered Trading Standards Institute will not charge you for making a complaint and if you are not satisfied with the outcome you can still bring legal proceedings. In addition, please note that disputes may be submitted for online resolution to the European Commission Online Dispute Resolution platform.

15.8 These Term & Conditions have Copyright protection. The document along with all other written content, images, photographs, template modifications or code on this website has automatic copyright protection.
